Kogi State Electricity Market Now Under KSERC Oversight

In line with the amended Constitution of the Federal Republic of Nigeria (CFRN) and the Electricity Act 2023, the Nigerian Electricity Regulatory Commission (NERC) has transferred regulatory oversight of Kogi State’s electricity market to the Kogi State Electricity Regulatory Commission (KSERC).

Under the Electricity Act 2023, NERC remains the central regulator for inter-state and international electricity generation, transmission, supply, and system operations. However, states are empowered to regulate intrastate electricity markets by formally notifying NERC and meeting specific legal requirements. The Kogi State Government has met these conditions, resulting in the transfer of regulatory authority.

Key provisions of the transfer order include directives for Abuja Electricity Distribution Company (AEDC) to establish a subsidiary (AEDC SubCo) to manage electricity supply and distribution within Kogi State. AEDC has been given 60 days, starting from September 13, 2024, to complete the incorporation of this subsidiary, which will then apply for a license from KSERC. All processes are expected to be completed by March 12, 2025.
