CISLAC Applauds Supreme Court’s Ruling on Anti-Corruption Agencies

The Civil Society Legislative Advocacy Centre (CISLAC) has praised the Supreme Court of Nigeria for its landmark ruling affirming the legality and prosecutorial powers of the country’s key anti-corruption agencies.

In a unanimous decision on Friday, a seven-member panel led by Justice Uwani Abba-Aji dismissed a suit filed by 19 state governments, led by Kogi State, challenging the establishment and powers of the Economic and Financial Crimes Commission (EFCC), Independent Corrupt Practices and Other Related Offences Commission (ICPC), and the Nigerian Financial Intelligence Unit (NFIU). The court ruled that the suit lacked merit and condemned the plaintiffs for their “selfish intentions,” reinforcing the supremacy of federal laws in combating corruption.

Victory for the Rule of Law

CISLAC described the verdict as a pivotal moment in Nigeria’s anti-corruption fight. The organization commended the judiciary for its steadfast commitment to justice and accountability, emphasizing that the decision ensures no individual or entity can derail the country’s anti-corruption efforts through frivolous legal actions.

Justice Abba-Aji’s assertion that state governments cannot enact laws that conflict with federal Acts establishing the EFCC, ICPC, and NFIU underscores the vital role of these agencies in addressing crimes at both state and federal levels.

Call for Collaboration and Reform

CISLAC urged state governments to cooperate with federal anti-corruption agencies and refrain from undermining their work. The organization called on the National Judicial Council (NJC) and Judiciary Staff Union of Nigeria (JUSUN) to investigate and sanction corrupt judges and judicial staff, while urging the Nigerian Bar Association (NBA) to discipline lawyers involved in unethical practices that compromise judicial integrity.

Additionally, CISLAC called for the National Assembly to constitutionally mainstream anti-corruption agencies to enhance their independence and operational sustainability.

Judicial Reform Advocacy

Highlighting the judiciary’s critical role in upholding justice, CISLAC advocated for comprehensive reforms to improve transparency, efficiency, and accountability in the judicial process. These changes are essential to restoring public trust in the justice system and reinforcing the fight against corruption.
